Acceptance of These Terms

These Terms of Use form an agreement between you and Ad Vitals concerning your access to GetAdVitals.com, your use of the website and your purchase or use of any Ad Vitals digital product.

By accessing the website, creating an account, completing a purchase or downloading a product, you confirm that you have read and agree to these Terms.

If you do not agree, do not use the website or purchase the products.

Eligibility and Account Responsibility

You must have the legal capacity to enter into a binding agreement in your location. If you are purchasing on behalf of a business, you confirm that you are authorised to bind that business to these Terms.

You are responsible for providing accurate checkout and account information and for protecting access to your email account, customer account and download links.

Notify us promptly if you believe your account or purchase details have been used without permission.

Orders, Prices and Payment

Product descriptions, prices and availability are shown on the website. Unless clearly stated otherwise, prices are displayed in United States dollars.

Your bank, card issuer or payment provider may apply its own currency-conversion rate or international transaction fee.

Placing an order is an offer to purchase. An order is accepted when payment is successfully processed and we provide order confirmation or digital access.

We may cancel or refund an order where payment is unauthorised, fraudulent, duplicated, incorrectly priced or affected by a technical error. We will not charge more than the amount confirmed at checkout without your agreement.

Upgrade products are intended only for customers who already own the resources identified on the relevant upgrade page. You are responsible for reviewing the eligibility wording before purchase. We may use order history or request order details to confirm ownership, prevent duplicate file delivery and provide the correct upgrade.

If you purchase the wrong upgrade, already own the included files or believe the order duplicates a previous purchase, contact support promptly. Any cancellation, correction or refund will be assessed under the Refund Policy and applicable law.

Digital Delivery

Ad Vitals products are supplied digitally. Nothing is physically shipped unless a product page expressly states otherwise.

Digital access may be provided through the order confirmation page, customer account, download link or email sent to the address used during checkout.

You are responsible for entering a working email address and for checking spam, junk and promotions folders. Contact us when a paid product cannot be accessed so that reasonable delivery support can be provided.

Each downloadable file is currently limited to five downloads. Customers should save a secure personal copy after downloading. Contact support if a genuine technical or delivery problem uses the available downloads before the file can be saved successfully.

Limited Product Licence

When you purchase an Ad Vitals digital product, bundle or upgrade, you receive a limited, non-exclusive, non-transferable and revocable licence to access and use only the files included in that completed order for:

• Your own personal advertising activities.
• Your own business’s internal advertising activities.
• Campaign work performed by you for a client, provided the original files are not transferred, resold or distributed to the client or any third party.
• Printing or completing reasonable working copies for the permitted purposes above.

Your purchase does not transfer ownership of the product, underlying content, design, brand, trademarks or other intellectual property.

Prohibited Use

Unless we provide prior written permission, you must not:

• Resell, sublicense, rent, distribute or give away the files.
• Upload the files to a shared drive, membership area, course, marketplace or public website for use by others.
• Copy, reproduce or adapt substantial portions to create a competing checklist, template, course or commercial product.
• Remove copyright, brand, attribution or ownership notices.
• Share download links or account access with unauthorised users.
• Use the website or products for unlawful, fraudulent, abusive or rights-infringing activity.
• Attempt to interfere with website security, checkout systems, accounts or digital-delivery controls.

We may suspend access where there is reasonable evidence of fraud, unlawful activity, unauthorised distribution, misuse of upgrade eligibility or another material breach of these Terms.

Intellectual Property

The website and Ad Vitals products—including their text, original frameworks, checklists, scorecards, graphics, page layouts, brand elements and downloadable files—are owned by or licensed to Ad Vitals and are protected by applicable intellectual-property laws.

“Ad Vitals,” the heartbeat branding and related original product names and designs may not be used in a way that suggests sponsorship, endorsement, partnership or ownership without written permission.

Advertising and Results Disclaimer

Ad Vitals provides educational and diagnostic information. It does not provide legal, financial, accounting or personalised professional advice.

Advertising performance depends on factors outside our control, including the product, market, pricing, website, customer demand, competition, tracking, creative execution, budget, platform systems and policy enforcement.

You remain responsible for reviewing your own campaign, verifying information, complying with applicable laws and platform policies, and deciding whether to launch, pause, change or increase spend.

Third-Party Platforms and Services

The website may refer to or interact with third-party services such as Meta, Facebook, Instagram, WooCommerce, payment processors, email providers, analytics services and website plugins.

Those services are governed by their own terms, policies, availability and technical systems. We do not control their decisions, outages, approvals, account restrictions, fees or changes.

Ad Vitals is an independent brand and is not affiliated with, endorsed by or sponsored by Meta Platforms, Inc. References to Meta, Facebook and Instagram are descriptive.

Refunds

Refund eligibility, including the voluntary 7-day clarity guarantee for an eligible purchase and the treatment of bundles or upgrade products, is governed by the Refund Policy, which forms part of these Terms.

Nothing in these Terms or the Refund Policy excludes a mandatory consumer remedy that cannot legally be excluded.

Disclaimers and Limitation of Liability

To the extent permitted by law, the website and digital products are provided on an “as available” basis without guarantees that access will always be uninterrupted, error-free or compatible with every device, browser or third-party service.

To the extent permitted by law, Ad Vitals will not be liable for indirect, incidental, special or consequential losses arising from your use of the website or products, including lost profits, advertising spend, lost data, lost opportunities or business interruption.

Where liability cannot legally be excluded, any limitation will apply only to the maximum extent permitted and subject to any applicable requirement of reasonableness.

Changes, Severability and Entire Agreement

We may update these Terms to reflect changes to the website, products, business practices or legal requirements. The current version will be posted on this page.

Changes will apply prospectively unless a different approach is required by law. Terms applicable to a completed purchase will not be materially changed retroactively merely by updating this page.

If any part of these Terms is found invalid or unenforceable, the remaining parts will continue to apply to the extent permitted by law.

These Terms, together with the Privacy Policy, Refund Policy, Disclaimer, the relevant product or upgrade page and the information presented at checkout, form the agreement concerning your purchase and use of the website and products.
